Use of the Website. These Terms and Conditions apply to the Website www.pure-excellence.be. By using this website, you (hereinafter the Customer) undertake to comply with and accept these terms and conditions. Purchases at Pure Excellence Antwerp BV. In addition, these General Conditions apply to all agreements entered into with Pure Excellence Antwerp BV. and include, among other things, the rights and obligations of the Customer as those of Pure Excellene Antwerp BV. The Customer declares that prior to entering into the agreement with Pure Excellene Antwerp BV. he/she has taken cognisance of the General Conditions of Pure Excellene Antwerp BV (published on www.pure-excellence.be, among others) and expressly approves and accepts them. This declaration of prior knowledge and express acceptance is made by the "internet customer" via electronic confirmation, and by the "non-Internet customer" from the moment of agreement to the offer and subsequent payment (or advance payment) of the agreed amount. This website was created and is operated by Pure Excellene Antwerp BV, Hoveniersstraat 55, bus 44, 2018 Antwerp, Belgium, KBO 1015.353.834, RPR Antwerp.
Article 1. DEFINITION, SCOPE AND SUBJECT MATTER
1.1. Definitions
- Pure Excellence Antwerp BV.: Pure Excellence Antwerp BV, company with its registered office at 2018 ANTWERPEN, Hoveniersstraat 55, Bus 44, KBO 1015.353.834, RPR Antwerpen, also trading under the trade names Pure Excelence Antwerp BV, www.pure-excellence.be - Buyer: any natural or legal person who is or will be in a contractual relationship of any kind with Pure Excellence Antwerp BV; - Consumer Buyer: any natural or legal person who, exclusively for non-professional purposes, acquires or uses products or services placed on the market; - Customer: any person who accesses the website(s) of Pure Excellence Antwerp BV and who is or will be in a contractual relationship with Pure Excellence Antwerp BV, whether or not; - Person: a natural person, a legal person or a de facto association; - Products: the subject and object of one or more agreements; - Prices and/or price statement on the website: The simple (price) mention of a product on the website(s) of Pure Excellence Antwerp BV never implies a final offer. Therefore, the Customer cannot derive any rights from it. (see below Products with fixed price statement, Products with indicative price statement, Guaranteed fixed price and art. 1.4. General Terms and Conditions)
- Fixed price products: The term 'fixed price products
'price statement' in current General Terms and Conditions refers only to
to the fact that the available product has a (reasonably) stable market price
and thus there will be little or no price fluctuations between the
simple (price) mention of the product on the Pure Excellence Antwerp BV website(s)
and the final price appearing in Pure Excellence Antwerp BV's offer
(see below Products with indicative price indication, Guaranteed fixed
price and Art. 1.4. General Terms and Conditions)
- Products with indicative price indication: the term 'products with indicative
'price statement' in current General Terms and Conditions refers only to
to the fact that the available product does not have a stable market price and therefore
is subject to (constant) market price fluctuations, this to

diamond components, edm...) or the composition of the available product
(e.g. in case of or customised designs). This includes
price fluctuations can occur between the simple

(guaranteed) fixed price and is binding on Pure Excellence Antwerp BV., for as long as the
offer applies (see further Art. 1.4 General Terms and Conditions).
- Website(s): the following websites (together or separately), which are operated by Pure Excellence Antwerp BV
managed: www.pure-excellence.be
- Methods of identification: The
security systems, to be used by the Customer for the
access to, and initiate, monitor its operations through Pure Excellence Antwerp BV
and secure. These include a login and password. Pure Excellence Antwerp BV has the right to adapt or change these Identifiers. In that
case, these newly created systems are also considered to be

1.2. Scope

1.3. Object, offers and errors
- Own label - Copyright protection
Pure Excellence Antwerp BV brings under its own name and label a high quality and
quality collection of jewellery and jewellery. This collection is

indemnify and hold it harmless against any claims or demands by
Pure Excellence Antwerp BV. or third parties as a result of any infringement thereof.
- Stock and offers
The products described on the Pure Excellence Antwerp BV website(s) and
Shown are an overview of Pure Excellence Antwerp BV's full range of products. The (price) mention of a product on the Pure Excellence Antwerp BV website(s) does not imply a final offer. A purchase is only concluded when the
(partial) payment is received from the customer and Pure Excellence Antwerp BV in the
ability to deliver the product to the customer. Pure Excellence Antwerp BV refers
to the extent necessary to its article 1.4 of the present General

- Our experts have made an approximate calculation of the number of
small diamonds in the jewellery based on the photos you have given us
forwarded. Please note that this number is an estimate

fact that any small reduction or increase in the number of small diamonds

refund the same amount. Of course, Pure Excellence Antwerp undertakes to be as
communicate the reason for repayment as soon as possible.
Should the Customer face certain ambiguities, then
he/she can always contact a representative of Pure Excellence Antwerp BV. The contact details of Pure Excellence Antwerp BV. can be found further in these General
Terms and conditions and listed on the website(s).
If the price, shown in the offer, for a particular product differs
of the actual price, then a representative of Pure Excellence Antwerp BV will contact the Customer before the purchased goods are dispatched
and allow him/her to pay the difference in price to Pure Excellence Antwerp BV or renounce the purchased good. Pure Excellence Antwerp BV apologises for any inconvenience that may arise from this
ensue.
- Jewellery without diamonds
Pure Excellence Antwerp is a diamond jewellery brand, selling only jewellery set with
diamonds. However, as a service to our customers who buy diamond jewellery
purchases/have purchased, Pure Excellence Antwerp offers (only) these customers the
ability to purchase jewellery without diamonds (e.g. gold
wedding rings without diamonds). But this service is expressly for
customers who purchased diamond jewellery separately. In summary, will
Pure Excellence Antwerp will not allow the purchase of jewellery without diamonds without
purchase of a diamond gem.
This paragraph concerning jewellery without diamonds does not apply to

Pure Excellence Antwerp provides several resources (Pure Excellence Antwerp App, free sent
ring gauge, possibility to measure ring size in our showrooms etc...)
so that customers are able to determine the correct ring size before their
order, even from a distance. Once the ring size is determined by the customer

responsibility of the customer and not of Pure Excellence Antwerp. This rule applies to

etc...). On top of that, given the wide variety in form and style of
rings with the artisanal nature of the product in mind, Pure Excellence Antwerp is in
no way able to guarantee that the thickness of the metal of the
finished product 100% matches the demonstration models (which are

the models may show slight differences regarding the ring size.
Pure Excellence Antwerp can never be held responsible for complaints regarding
the order of the incorrect ring size and will pay the cost of return and
do not assume the size adjustment. These costs are always for the benefit of

- Determination of conformity of delivered products
Given that our products are handmade and images and
videos of the demonstration models online may be slightly different than in
reality because each screen is calibrated differently, is

1.4. Formation of an agreement
Purchase intention
Before there can be an agreement between the Internet Customer and
Pure Excellence Antwerp BV, the Customer must first tick a particular product and the

In addition to fixed-price products (see Art. 1.1 Definitions), the customer may

Establishment of the agreement:
The agreement is concluded at the time the Customer makes the offer

Conditions of Pure Excellence Antwerp BV has read and approved and Pure Excellence Antwerp BV has issued an order confirmation to the Customer. In the event that the offer is made via

transferred to the e-mail address provided by the Customer. The agreement
between the Customer and Pure Excellence Antwerp BV always provides for an express resolutive
clause. (see below)
Express cancellation clause:
Any agreement entered into with Pure Excellence Antwerp BV is made under the
express cancellation clause of payment of the price within the predetermined
period Pure Excellence Antwerp BV invokes Section 1184 of the Civil Code to this extent.
If Pure Excellence Antwerp BV has not received payment or confirmation of payment from the customer

Valid agreement:

1.5. What materials & diamonds are used by Pure Excellence Antwerp?
Pure Excellence Antwerp BV works exclusively with 18-carat gold (75% gold) - alloy 'au750' and
platinum 950 (95% platinum) - alloy 'pt950'.
Pure Excellence Antwerp offers only 100% natural diamonds. In other words, no "lab grown",
no treated, no artificial and no diamonds enhanced in clarity. In this
respect Pure Excellence Antwerp uses the most advanced tools to detect diamonds

Article 2. AVAILABILITY, IDENTIFICATION AND SECURITY
2.1. Availability

In order for the customer to export his order correctly, Pure Excellence Antwerp commits to the

refund. In the event that Pure Excellence Antwerp decides to refund the
reimbursement procedure for an airport not on the above list, from

Article 4. THE DELIVERY MODALITIES

first delivery by itself. Returns, 2nd or subsequent deliveries after
adjustments or repairs are the responsibility of the customer.

Pure Excellence Antwerp strives for excellence in terms of delivery times. Since 2008
Pure Excellence Antwerp has already delivered more than 95% of its parcels on time, regardless of
the destination. That said, although Pure Excellence Antwerp is working with the
most reputable shipping partners (FedEx, UPS, DHL, Brinks et cetera),
Pure Excellence Antwerp has sole control over the timely shipment of a parcel. A
delay during delivery is always a possibility and therefore falls outside
our control. No company in the world can be sure of 100% a
guarantee timely delivery. This is impossible because we have to

Article 5. DIAMANT CERTIFICATES
5.1. Diamond Certificate
If the 'Diamond grading report' is lost, damaged or replaced, Pure Excellence Antwerp BV will charge an administrative fee to the Customer. This administrative fee
is estimated at a flat rate of EUR 190.00.
5.2. Certificates used
Pure Excellence Antwerp processes only high-quality diamonds in its jewellery. You also get
Standard with any Pure Excellence Antwerp jewellery that has a diamond equal to or greater than 0.30
carat includes a certificate from an accredited laboratory certifying the 4Cs of your diamond
describes. These laboratories are exclusively HRD, IGI or GIA. If a customer
prior to purchase a specific preference for a
particular laboratory indicates, Pure Excellence Antwerp will endeavour to meet it.
Unless explicitly stated, Pure Excellence Antwerp will never give a guarantee on this. Also
the customer expressly agrees to the quality description of the diamonds as
described on the delivered certificates. Consequently, Pure Excellence Antwerp will comply with any subsequent
disputes in this regard.
Article 6. VISIBLE FAULTS
6.1. Visible defects
Pure Excellence Antwerp BV expressly asks its customers to keep the purchased and (delivered)
products immediately upon receipt. Complaints of
the Customer, relating to defects in the product or delivery, which are
externally observable, must be observed by the Customer within 2 months of delivery or
reception at one of the showrooms as communicated on the website(s) of
Pure Excellence Antwerp BV must be notified to Pure Excellence Antwerp BV in writing.
6.2. Cost of return
After the Customer was contacted by a representative of Pure Excellence Antwerp BV

Article 7. RIGHT OF DELIVERY AND RETURN
7.1. Statutory renunciation right

personal nature. Consequently, the right of withdrawal is not applicable to these articles

- With most purchases at Pure Excellence Antwerp, there is always a period between payment
and receipt. Occasionally, however, it is possible to receive a gem that is
in stock at one of the showrooms, pay and take it with you straight away

- The Customer must return the purchased product on which he/she waives the right of renunciation

- We advise the Customer to treat their purchase with care and keep it
returned in their original packaging, complete with all documentation and
